1. ACCEPTABLE USE POLICY
1.1 Purpose
This policy defines acceptable and prohibited uses of the Bae-i platform.
1.2 Acceptable Uses

Engage in conversations with AI avatars for entertainment, education, or information

Purchase tokens and access premium features

Provide feedback to improve the service

Share your experience (without sharing private conversation content)
1.3 Prohibited Uses
You may NOT use Bae-i to:

Harass, threaten, or abuse avatars or other users
•
Attempt to extract personal information about creators

Engage in illegal activities or solicit illegal services
•
Distribute malware or attempt to compromise platform security
•
Scrape, data mine, or automatically collect content
•
Create multiple accounts to circumvent restrictions or exploit promotions
•
Resell access to avatars or platform features
•
Use avatars for commercial purposes without authorization
1.4 Consequences
Violations may result in warnings, suspension, permanent ban, token forfeiture, or legal action.
2. AGE VERIFICATION POLICY
2.1 Minimum Age
Users must be at least 18 years old to use Bae-i.

2.3 Parental Responsibility

3. AI DISCLOSURE POLICY
3.1 Purpose
This policy provides transparency about how Bae-i uses artificial intelligence and machine learning technologies, in compliance with applicable regulations including California AB 2013 (effective January 1, 2026) and the EU AI Act (Regulation 2024/1689).

3.3 AI Training Data
We train AI models using content provided by creators under Creator Licensing Agreements:

All creator content is used under express written license. Creators retain ownership of original content and grant Bae-i rights for AI training, format conversion, and derivative works.
We do not train AI models on user conversations or interaction data. User interactions are processed on an inference-only basis to deliver responses in real time and to power each user’s personal conversation memory feature. We may use aggregate, non-content operational metrics (such as error rates and latency statistics) to monitor and improve system reliability — these metrics contain no conversation content. If we ever propose to train models on user interaction data, we will update this policy and offer an opt-out before any training begins.

3.5 Model Types and Deletion Capabilities
Bae-i operates two categories of AI models with different characteristics:

Do not present any “unlearning” limitation
These include safety classifiers, quality scoring systems, and general conversational improvement models trained on aggregate data. Shared models:

Pursuant to the EU Artificial Intelligence Act (Regulation 2024/1689), applicable from August 2, 2025:
Our AI avatar systems are designed for entertainment and informational purposes. They are not intended for use in high-risk categories defined under the AI Act.
Our AI systems are trained on:

You may opt out of having your interaction data used for AI training by contacting us at legal@baei.ai or using the request methods described in the Privacy Center. Note: Opting out does not affect AI models already trained, and we may still use your data for safety, abuse prevention, and legal compliance.
You may request access to or deletion of your data per our Privacy Policy. See the Deletion Policy (Section 12) for information about limitations regarding trained AI models.
3.10 Updates
We may update this policy to reflect changes in our AI practices or regulatory requirements. Material changes will be announced with 30 days’ notice.
4. ANTI-FRAUD POLICY
4.1 Prohibited Activities
The following are strictly prohibited:

4.2 Detection and Prevention
We employ automated systems and manual review to detect fraudulent activity. Suspicious accounts may be restricted pending investigation.

Confirmed fraud results in immediate permanent ban, forfeiture of all tokens and earnings, and potential legal action and law enforcement referral.
5. BIOMETRIC DATA POLICY
5.1 Scope
This policy applies to biometric identifiers and biometric information collected from creators and users.

5.4 Consent
Creators: Provide explicit consent through the creator application clickwrap flow and Creator Licensing Agreement before biometric data collection.
Users: Where required by applicable biometric or recording consent laws, Bae-i presents a pre-session click-through disclosure before the first covered voice or video interaction begins. That disclosure identifies the biometric identifiers, recordings, or related session artifacts collected, the purposes for collection and processing, and the applicable retention period. Users must provide an affirmative acknowledgment before the covered session begins.
Starting a voice or video interaction after that disclosure constitutes acknowledgment and consent to the recording and storage practices described in the Privacy Policy, including Sections 1.3 and 1.4. Users may stop using voice or video features at any time, but once a session begins, transcripts, conversation memory, and related session artifacts may still be retained as described in the Privacy Policy.

Creators must own or have proper licenses for all content they provide. See Creator Licensing Agreement Section 4 for representation and warranty requirements.
8.3 Reporting Copyright Concerns
If you believe content on the platform infringes your copyright — including creator-uploaded knowledge base materials, avatar outputs, profile materials, or public-facing platform content — report it to legal@baei.ai. Please include enough detail for us to identify the work you believe is infringed and the material you are reporting, along with your contact information. We review copyright reports promptly and will remove or restrict access to content where appropriate.
If you believe content was removed in error, contact legal@baei.ai and we will review the removal.

9. CREATOR CODE OF CONDUCT
9.1 Professional Standards

10. CREATOR PAYOUT POLICY
10.1 Revenue Share
Creators receive 70% of Net Revenue from paid interactions with their twins. Free Tokens are provided without a corresponding customer payment. Free Tokens do not generate Gross Revenue or Creator earnings. Net Revenue is Gross Revenue minus itemized Platform Costs, including Voice, Video & Text Services, Monthly Twin Knowledge Maintenance, and any applicable One Time Video Creation Fee. See Creator Licensing Agreement Section 3 for the full definitions.
10.2 Billing Cycle and Payment Schedule

Creators are responsible for their own taxes. US creators must provide W-9 information. International creators may be subject to withholding.

12.5 AI Model Limitations
AI models learn by identifying statistical patterns across large amounts of data. Once a shared model is trained, it does not contain retrievable copies of the original data. Instead, it contains mathematical weights and parameters that represent learned patterns.
Dedicated Creator Models (Fully Deletable)
Each creator has dedicated AI models including their voice clone, video avatar model, and knowledge base. These models are specific to the individual creator and can be completely deleted upon termination. No “unlearning” limitation applies to dedicated models.
Shared Platform Models (Technical Limitation)
Shared models used for safety, quality scoring, and general platform improvements are trained on aggregate, anonymized data from many users and creators. Current AI technology cannot:

Identify which parameters came from which specific data
•
Selectively remove one person’s contribution from a trained shared model
•
“Unlearn” specific information without retraining from scratch
This is an industry-wide technical limitation, not a Bae-i policy choice.
When you delete your data:

14.5 Web Beacons and Pixels
We use web beacons and pixels to track email opens, measure advertising effectiveness, and understand user behavior. In particular, commercial and creator outreach emails we send may contain (a) a 1-pixel tracking image used to estimate whether the email was opened, and (b) click-redirect URLs that route through our infrastructure before forwarding to the destination so we can record link clicks. The identifiers we send to our analytics processors are pseudonymous (hashed) — we do not transmit raw recipient email addresses for these analytics purposes.
Recipients in the EU, UK, EEA, and Switzerland are excluded from pixel and click-redirect tracking unless we have obtained your consent. You can opt out of all marketing emails at any time by clicking the unsubscribe link in any commercial message we send (which honors the email-client one-click List-Unsubscribe header) or by emailing legal@baei.ai. We process unsubscribe requests within 10 business days as required by CAN-SPAM, and immediately where required by GDPR/PECR.
14.6 Subprocessor List on Request
A current list of our subprocessors — including each provider’s name, purpose, and processing location — is available on request by emailing legal@baei.ai. We provide updated lists on reasonable request and notify customers under active data processing agreements of material subprocessor changes in line with GDPR Art. 28(2).
14.7 California Privacy Choices
We do not sell personal information for money. Optional analytics or advertising technologies may constitute “sharing” for cross-context behavioral advertising under California law. California residents may opt out of sale or sharing and limit certain uses of sensitive personal information by using the cookie preference center where available or by contacting legal@baei.ai.
We do not currently process browser-based Global Privacy Control signals automatically. To submit a CPRA opt-out request, contact legal@baei.ai or use the request methods described in this Privacy Center.
15. DO NOT TRACK DISCLOSURE

Creators retain ownership of their original content. They grant Bae-i a license for platform use as specified in the Creator Licensing Agreement.
17.3 User IP
Users retain rights to original content they create. They grant Bae-i a license to use such content for service operation.
17.4 AI-Generated Content
AI-generated avatar responses are owned by Bae-i and the applicable creator. Users may not claim ownership of AI-generated content.
18. LAW ENFORCEMENT GUIDELINES
18.1 Legal Process Requirements
We require valid legal process (subpoena, court order, or warrant) before disclosing user data to law enforcement.
18.2 Emergency Requests
In emergencies involving imminent threat to life, we may disclose information without legal process.
18.3 User Notification
Where legally permitted, we will notify users of law enforcement requests for their data.
18.4 Requests
Law enforcement should direct requests to legal@baei.ai with documentation of authority and specific data requested.
19. MINOR SAFETY POLICY
19.1 Age Requirement
Bae-i is for users 18 and older. We do not knowingly collect data from minors, and we do not knowingly process sensitive personal information of consumers under 16.
19.2 Discovery of Minor Users
If we discover a user is under 18, we will:

21. PAYMENTS POLICY

Payments are processed by payment processors and app marketplace billing providers. We do not store full payment card numbers.

Applicable taxes are added at checkout based on your location.
21.4 Payment Security
We use industry-standard encryption and security measures. Review the privacy policy shown by the payment processor or app marketplace checkout provider for that provider’s practices.

23. REFUND POLICY
23.1 General Rule
Token purchases are final and non-refundable.
This Refund Policy is incorporated into the Terms of Service. Each purchase is governed by the refund terms in effect at the time of that purchase.
23.2 Exceptions
Refunds may be provided for:

Technical errors resulting in duplicate charges

Service outages preventing token use
•
Account termination by Bae-i without cause

Future changes to refund terms apply prospectively to later purchases and ongoing platform use unless applicable law requires otherwise.

25. REGIONAL & INTERNATIONAL PRIVACY DISCLOSURES
25.1 California (CCPA/CPRA)
This California Privacy Notice supplements the Privacy Policy and applies only to California residents within the scope of the CCPA/CPRA.
Rights: California residents have the right to know, access, correct, delete, opt out of sale or sharing, limit certain uses of sensitive personal information, appeal where required by law, and receive equal service and pricing regardless of whether they exercise their privacy rights.

Sources: We collect personal information directly from you, automatically from your use of the Services, and from third parties such as authentication, payment, analytics, advertising, and creator tooling providers.
Purposes: Service provision, personalization, AI training and improvement where permitted, safety, security, fraud prevention, analytics, compliance, creator operations, and limited marketing.
Sensitive Personal Information: We do not collect precise GPS location through avatar sessions. We may collect the categories of sensitive personal information identified above, but we do not use or disclose sensitive personal information for cross-context behavioral advertising or to infer characteristics beyond what is necessary to provide the Services, maintain security, detect fraud, or comply with law.
Do Not Sell or Share Personal Information: We do not sell personal information for monetary consideration. We may disclose identifiers and online activity to advertising and analytics partners in ways that may constitute “sharing” under California law. Because the Services are limited to adults, we do not knowingly process sensitive personal information of consumers under 16, and we do not knowingly sell or share personal information of consumers under 16. See Minor Safety Policy (Section 19). To submit an opt out request, contact legal@baei.ai or use the request methods described in the Privacy Center.
Paid Services Disclosure: Paid subscriptions, token purchases, and paid avatar interactions are ordinary commercial transactions. Bae-i does not offer credits, discounts, or feature access in exchange for allowing AI training use of personal information a user could otherwise decline.
California “Shine the Light” Disclosure: California residents may request information about whether we disclosed certain categories of personal information to third parties for their own direct marketing purposes by contacting legal@baei.ai with “Shine the Light Request” in the subject line.
California AB 2013 Disclosure: See AI Disclosure Policy (Section 3.4) for required disclosures about AI training data, including data categories, licensing status, and collection timeframes.
25.2 Nevada
You have the right to opt out of sale of personal information for monetary consideration. Submit requests to legal@baei.ai.
25.3 Illinois, Texas, Washington

25.4 Vermont
We will not disclose creditworthiness information to affiliates or share personal, financial, credit, or health information with non-affiliated third parties for marketing without authorization.

“Personal Data” includes “personal information” under the Privacy Act 1988 (Cth).
Bae-i complies with the Australian Privacy Principles (“APPs”). Personal information may be transferred to the United States or other jurisdictions where our infrastructure or service providers operate. In accordance with APP 8 (Cross-Border Disclosure), we take reasonable steps to ensure overseas recipients handle personal information in a manner consistent with the APPs.
Under APP 6 (Use and Disclosure), we use and disclose personal information only for the purposes described in the Privacy Policy or for purposes reasonably related to those primary purposes.
Bae-i acknowledges the statutory tort for serious invasions of privacy introduced under the Privacy and Other Legislation Amendment Act 2024 and maintains safeguards designed to prevent misuse of personal, biometric, or audiovisual data.
If we use personal information to make automated decisions that could reasonably be expected to significantly affect your rights or interests, we will provide the legally required information and transparency through this Policy Centre, the Privacy Policy, and/or on a case-by-case basis.

25.7 Brazil (LGPD)
Rights under Article 18 include confirmation, access, correction, anonymization, portability, deletion, and information about sharing.

We process data in accordance with the Digital Personal Data Protection Act. You may nominate someone to exercise rights upon death or incapacity.

We may rely on “deemed consent” where you voluntarily provide data.

26. TOKEN POLICY
26.1 Nature of Tokens
Tokens are digital content providing access to platform services. They have no monetary value and cannot be redeemed for cash.
26.2 Purchase

1 Token = $1.00 USD base price

Mandatory platform, provider, and marketplace fees are included in the displayed price where required by applicable law
26.3 Usage

Tokens consumed based on session duration and avatar rates
•
Video sessions have a minimum charge of 0.5 minutes
•
Unused tokens expire per the terms disclosed at time of purchase
26.4 Restrictions
Tokens cannot be sold, traded, or transferred. They may be forfeited for Terms violations.

Our platform may contain links to third-party websites and services. We are not responsible for their content, privacy practices, or terms. Review third-party policies before using their services.
28. SOCIAL MEDIA PLUGINS DISCLOSURE
We may use social media plugins that allow direct interaction with those platforms. These plugins may collect data according to their privacy policies. You can control plugin behavior through browser settings.
29. UPDATES & NOTIFICATIONS POLICY
29.1 Policy Updates
We may update these policies from time to time. Material changes will receive advance notice where required by law or where the change materially affects your rights or obligations. Continued use after the effective date of an update constitutes acceptance of the updated policies.
